Legal Services
Tailored IP Solutions concentrates its legal practice on trademark, copyright, and related matters. The same attorney handles each engagement from start to finish, whether the matter involves an initial clearance search or a multi-jurisdiction enforcement strategy.
Trademark
Trademark work forms the core of the practice and covers the full life cycle of a mark. The firm represents clients before the United States Patent and Trademark Office (“USPTO”) and the Trademark Trial and Appeal Board (“TTAB”). Tailored IP also helps clients secure, protect, expand, and enforce trademark rights in the United States and abroad. Whether an engagement involves a single application or an established portfolio, Tailored IP builds the strategy around how the client operates, which priorities matter most, and where the business is heading. The objective is a durable position that can withstand challenge and support growth.
Clearance & Registration
Strong trademark rights begin before filing. A thorough clearance search and candid registrability opinion can identify conflicts before launch and shape a filing strategy around the client’s intended use and broader business objectives.
- Clearance searches and registrability opinions
- Application preparation and filing in the United States and abroad, covering word marks, logos, slogans, trade dress, and other nontraditional marks
- Madrid Protocol filings, direct foreign filings through local counsel, and other international filing strategies
- U.S. applications based on foreign applications or registrations
- Office action responses addressing procedural and substantive issues
- Statements of use, extension requests, and other pre-registration filings
Counseling & Portfolio Management
Securing a registration marks one stage in building and maintaining trademark rights. Within an ongoing portfolio engagement, Tailored IP reviews the portfolio on an agreed schedule, flags deadlines, and raises risks and opportunities as the business and portfolio evolve. With the client’s authorization and required input, the firm handles the filings needed to maintain or expand protection. Counseling also examines whether actual use continues to support the rights the client intends to preserve.
- Portfolio audits and trademark development counseling
- Trademark monitoring and watch services
- Maintenance and renewal filings
- Expansion strategy for new territories, additional goods and services, and families of marks
- Assignments, licensing, and changes of ownership
- Coexistence, consent, and settlement agreements
- Recording registered trademarks with U.S. Customs and Border Protection
- INFORM Consumers Act counseling and auditing
- Trademark counseling involving AI, NFTs, metaverse platforms, and other emerging technologies
Enforcement & Disputes
Effective enforcement requires more than answering every instance of infringement in the same way. Tailored IP evaluates the nature of the threat and develops a proportionate strategy, whether the appropriate response involves a demand, a TTAB proceeding, platform action, or a coordinated anti-counterfeiting effort. The firm also represents businesses responding to infringement and related claims. When a matter extends outside the United States, Tailored IP coordinates with foreign counsel to account for local law and procedure.
- Cease-and-desist strategy, including demand and response letters
- TTAB proceedings, including oppositions, cancellations, and appeals from refusals of registration (ex parte appeals)
- USPTO petitions and submissions, including expungement and reexamination proceedings and letters of protest
- Anti-counterfeiting strategy development and implementation
- International enforcement strategy and coordination with foreign counsel
- Grey-market goods and parallel-import enforcement
- Online marketplace and platform enforcement, including takedowns and e-commerce enforcement tools
- Domain name counseling and disputes, including UDRP proceedings and cybersquatting matters
- Federal Lanham Act unfair competition matters, including competitor false-advertising claims and false endorsement claims
- Related claims, including right of publicity matters
Copyright
Copyright generally protects an original work once the author fixes the work in a tangible medium. Registration creates a public record of the claim and, for U.S. works, generally serves as a prerequisite to an infringement lawsuit. Timely registration may make statutory damages and attorneys’ fees available, which can strengthen deterrence and enforcement leverage. Agreements governing ownership and use determine who controls the work and on what terms.
- Copyright registration and portfolio management
- Ownership and use agreements, including work-made-for-hire agreements, assignments, licenses, joint-authorship arrangements, and permissions for third-party works
- Recordation of assignments and other Copyright Office filings
- Fair use opinions and counseling
- Enforcement and anti-piracy strategy in the United States and abroad
- Digital Millennium Copyright Act (“DMCA”) platform-liability and safe-harbor counseling, including takedown notices, counter-notices, and responses
- International copyright strategy, including foreign registration where available and coordination with local counsel for enforcement
- Recording registered copyrights with U.S. Customs and Border Protection
- Renewal and maintenance matters for eligible legacy works
- Copyright counseling involving AI-generated or AI-assisted content, NFTs, metaverse projects, and other emerging technologies
