These Terms of Use and Disclaimer (“Terms”) govern your use of tailoredipsolutions.com and its related website features (“Site”), operated by Tomasz R. Barczyk d/b/a Tailored IP Solutions (“Tailored IP”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. General Information; No Legal Advice
The Site provides general information about Tailored IP and legal topics. It is not legal advice, does not address every fact or jurisdiction, and is not a substitute for advice from a lawyer who has reviewed your circumstances. Laws and interpretations change, and Site content may not be current, complete, or applicable to you. Do not act or refrain from acting based only on Site content.
2. No Attorney-Client Relationship
Using the Site, submitting an inquiry or intake form, uploading a document, receiving an automated response, scheduling or paying for a consultation, or having Tailored IP review information does not by itself create an attorney-client relationship or obligate Tailored IP to represent you. An attorney-client relationship begins only when Tailored IP has completed its conflicts and intake review, agreed to the scope and terms of representation, and expressly accepted the engagement in a written agreement signed or otherwise confirmed by both sides.
Until Tailored IP expressly accepts an engagement, you remain responsible for protecting your rights and meeting all deadlines. Do not assume that Tailored IP is monitoring a deadline, filing, or matter because you contacted the Site, booked a consultation, or received an acknowledgment.
3. Prospective-Client Information and Intake
The Site includes forms designed to receive information needed for an initial inquiry, conflict check, or evaluation of a possible matter. You may use those forms to provide the information they request. Tailored IP uses that information for intake and conflict-review purposes and handles qualifying prospective-client information in accordance with applicable professional duties even if no engagement follows. A submission is not necessarily protected by attorney-client privilege, which depends on the circumstances and applicable law.
Please provide only information reasonably requested by the form and needed for the initial review. Do not submit Social Security numbers, account passwords, full payment-card details, or unrelated confidential material. Do not send sensitive information by ordinary or unencrypted email unless Tailored IP asks for it and confirms the appropriate method. Identifying all relevant persons and entities helps Tailored IP perform a conflict check, but a conflict check does not guarantee that representation will be available. If you are unsure whether to send particular information, first contact info@tailoredipsolutions.com without including the sensitive information.
4. Electronic Communications and File Security
The Site transmits forms over HTTPS and stores form, contact, booking, and transaction information in access-controlled Wix business records. After the private-upload configuration has been released and verified, files submitted through the trademark and copyright intake forms will be stored as private Wix Media Manager files and accessed through authenticated, time-limited links rather than ordinary public media links. These measures reduce risk but cannot eliminate it. No Internet transmission or storage system is guaranteed to be secure. If you do not wish to send information through the Site, contact Tailored IP to discuss another method before transmitting it.
5. Consultations, Booking, and Payment
Availability shown through the Site is not a promise that Tailored IP will accept a matter. Consultation, cancellation, rescheduling, payment, and refund terms displayed during booking or checkout apply to that transaction and control over these Terms if they directly conflict. Payment-card information is entered through Wix-hosted and Stripe-supported checkout and is not collected in the Site’s own intake forms. A consultation may involve professional duties to a prospective client, but it does not by itself create an ongoing attorney-client relationship or an obligation to take further action.
6. No Guarantee of Results
Any description of experience, representative matters, outcomes, testimonials, or past results is provided for context only. It does not promise or guarantee a similar result. Outcomes depend on the facts, law, forum, decisionmakers, other parties, and circumstances of each matter.
7. Site Content and Third-Party Services
The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, Tailored IP disclaims express and implied warranties concerning the Site, including warranties of accuracy, completeness, timeliness, availability, merchantability, fitness for a particular purpose, title, and noninfringement.
The Site may link to or use services operated by others, including Wix, Stripe, Microsoft, and Google. Tailored IP does not control and is not responsible for third-party content, availability, security, or privacy practices. A link is not an endorsement. Your use of a third-party service may be governed by that provider’s terms and privacy notice.
8. Intellectual Property and Limited License
Unless otherwise stated, the Site and its original content, design, text, graphics, and branding are owned by or licensed to Tailored IP and are protected by applicable intellectual-property laws. “Tailored IP Solutions” and “Tailored IP” are trade names or marks of Tailored IP. Tailored IP grants you a limited, revocable, nonexclusive, nontransferable license to view, download, and print Site content for your personal, noncommercial informational use. You may not reproduce, republish, modify, sell, distribute, display, frame, scrape, or exploit Site content for commercial advantage without prior written permission, except as law permits.
9. Acceptable Use
You may not use the Site to violate law or another person’s rights; transmit malicious code; probe, disrupt, or bypass security or access controls; impersonate another person; submit information you are not authorized to disclose; interfere with Site operation; or use automated means to extract content or data except as expressly authorized. Tailored IP may restrict access, remove submissions, or take protective action when reasonably necessary to address misuse or security risk.
10. Limitation of Liability
To the fullest extent permitted by law, Tailored IP will not be liable for actions taken or not taken solely in reliance on Site content, or for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or inability to use the Site, reliance on Site content, or third-party services. Nothing in these Terms excludes liability or limits rights that cannot lawfully be excluded or limited. Your sole remedy for dissatisfaction with the Site is to stop using it; this sentence does not limit any rights arising under a separate engagement agreement or applicable law.
11. Governing Law; Severability
These Terms are governed by Illinois law, without regard to conflict-of-laws principles, except where applicable law requires otherwise. If a provision is held unenforceable, it will be limited to the minimum extent necessary, and the remaining provisions will continue in effect. These Terms do not amend or replace any engagement agreement.
12. Changes
Tailored IP may update these Terms by posting a revised version and changing the effective date above. Changes apply prospectively from the stated effective date. Continued use of the Site after that date constitutes acceptance of the revised Terms. Terms displayed and accepted for a particular booking or checkout transaction remain subject to the version applicable to that transaction unless law or those terms provide otherwise.
13. Attorney Advertising and Jurisdiction
ATTORNEY ADVERTISING. The lawyer responsible for this Site is Tomasz R. Barczyk. The Site is directed to persons seeking services that Tailored IP may lawfully provide. Availability of the Site in a jurisdiction does not mean that Tailored IP is authorized or willing to provide legal services there, and the Site is not intended as a solicitation where it would violate applicable law or professional rules.
